Which terms apply

Purchases and sales are governed by the individual signed contract, by the trade association form incorporated in it where one applies, and by our general terms of purchase or sale. Terms of a counterparty that conflict with ours apply only where we have accepted them in writing.

GAFTA or FOSFA forms where applicable to the commodity

Governing law

Austrian law, excluding its conflict-of-law rules

Jurisdiction

Arbitration under the applicable trade association rules, or the courts competent for Leoben, as agreed in writing

Sanctions clause

Every contract we sign contains a clause entitling either party to suspend or terminate performance where performance would breach applicable restrictive measures or export control law

Force majeure

As set out in the incorporated trade form, or in our general terms where no trade form applies

Inspection

Quantity and quality final at load port as determined by the appointed independent inspection company, unless otherwise agreed
